Terms of Service

These Terms of Service ("Terms") are an agreement between you and MAGE ID ("we," "us," or "our") for your use of the MAGE ID mobile and web applications, marketing site, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
1. Eligibility
You must be at least 18 years old and have legal authority to enter into this agreement. If you're using MAGE ID on behalf of a business, you represent that you have authority to bind that business to these Terms.
2. Your Account
You're responsible for keeping your login credentials secure and for everything that happens under your account. If you suspect unauthorized access, contact us immediately at help@mageid.app. We're not liable for losses caused by your failure to safeguard your credentials.
3. Subscriptions, Billing, and Trials
MAGE ID offers free and paid subscription tiers (currently Pro, Business, and Enterprise). Paid subscriptions are billed monthly or annually as selected at checkout, in U.S. dollars.
- Auto-renewal: Paid subscriptions renew automatically at the end of each billing period unless you cancel before renewal. Your payment method will be charged the then-current rate.
- Cancellation: You can cancel anytime. On iOS, manage your subscription in Settings → Apple ID → Subscriptions. On Android, in Google Play → Subscriptions. Cancellation takes effect at the end of the current paid period — you keep access until then.
- Refunds: Refund requests are handled by Apple (App Store) or Google (Play Store). MAGE ID does not directly issue refunds for in-app purchases.
- Free trials: If you start a free trial, you must cancel at least 24 hours before the trial ends to avoid being charged.
- Price changes: We may change subscription prices. We'll notify you in advance, and changes apply only to renewals after the notice period.
4. The Service and Your Use of It
MAGE ID is a construction-management platform. You may use the Service to manage projects, estimates, schedules, financials, communications, and other workflows related to your construction business or, as a homeowner, to find and engage with contractors.
You agree not to:
- Use the Service for illegal activity or in violation of any law.
- Reverse-engineer, decompile, or attempt to extract source code.
- Scrape or bulk-extract data from the Service.
- Resell or sublicense the Service without our written permission.
- Upload malware, viruses, or content that infringes others' rights.
- Misrepresent your identity, licensing status, or qualifications.
- Use the Service to harass, defraud, or abuse anyone.
5. The MAGE ID Marketplace
MAGE ID is the venue. We're not the deal. Homeowners post projects and contractors bid. The contract that follows is between those two parties — not us. Specifically:
- We are not a party to any agreement between a homeowner and a contractor. The project, the payment, the warranty, and any dispute are between you and the other side.
- We do not vouch for licensing, insurance, qualifications, work quality, pricing, or honesty. Badges and profile fields reflect what users uploaded — not our verification. Confirm a contractor's license, insurance, and references yourself before signing anything.
- Contractors are responsible for every law that applies to the work — licensing, registration, lien rules, consumer-protection, employment, tax. We don't track that for you.
- If you have a dispute with another user, work it out with that user. We won't mediate or arbitrate it.
6. Your Content
You retain ownership of the project data, photos, drawings, messages, and other content you upload ("Your Content"). By uploading, you grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, and display Your Content solely to operate the Service for you and the users you've shared it with (e.g., clients in your portal, subs you've invited, the architect/engineer you've sent an RFI to).
You represent that you have the right to upload Your Content and that it doesn't violate anyone's rights or any law.
We do not sell Your Content. We do not use Your Content (including AI inputs and outputs) to train AI models.
7. AI Features
The Service includes AI-assisted features (estimates, schedules, code checks, summaries, etc.) provided by third-party AI vendors (currently Anthropic and others). AI outputs:
- Are provided "as is" — they may contain errors, hallucinations, or out-of-date information.
- Are not professional advice. Don't rely on AI estimates, code checks, or risk analyses without verification by a qualified licensed professional (architect, engineer, code official, attorney, CPA).
- Don't replace your judgment as a contractor or your obligation to comply with codes, permits, and laws.
8. Construction-Specific Disclaimer
Construction is regulated, safety-sensitive work. MAGE ID is a tool, not a contractor, architect, engineer, code official, or attorney. Estimates, schedules, photos, daily reports, takeoffs, code checks, and other outputs from the Service are informational. You — and the licensed professionals you engage — are solely responsible for project execution, code compliance, worker safety, permitting, and quality of work.
9. Payments Processed Through MAGE ID
When you accept payment from a client through our Stripe integration, you authorize MAGE ID and Stripe to process those payments. You are responsible for any chargebacks, refunds, and disputes initiated by your clients. MAGE ID is not a bank, money transmitter, or escrow agent. You must comply with Stripe's terms in addition to ours.
10. Intellectual Property
The Service — including software, design, brand, content, and trademarks — is owned by MAGE ID or our licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. No other rights are granted.
11. Termination
You can stop using the Service at any time and delete your account in the app (Settings → Delete Account). We may suspend or terminate your account if you violate these Terms, abuse the Service, or fail to pay. We'll provide notice when we can. On termination, your right to use the Service ends; provisions that should reasonably survive (Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution) survive.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the Service will be uninterrupted or error-free. We do not warrant any results from your use of the Service.
13. Limitation of Liability
To the maximum extent permitted by law, MAGE ID and our affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising from or related to the Service — even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claim arising from or related to the Service will not exceed the greater of (a) the amount you paid us in the twelve (12) months before the claim or (b) one hundred U.S. dollars ($100).
14. Indemnification
You will indemnify, defend, and hold harmless MAGE ID and our affiliates from any claim, demand, loss, or damages (including reasonable attorneys' fees) arising from (a) Your Content; (b) your use or misuse of the Service; (c) your violation of these Terms or any law; or (d) any project, contract, or transaction you enter into with another user through the marketplace.
15. Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service that isn't resolved by direct communication will be resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration will take place in New York County, NY. You waive any right to participate in a class action or class arbitration. Either party may bring a claim in small-claims court if it qualifies.
16. Changes to These Terms
We may update these Terms. If we make material changes, we'll notify you by email or in the app. Continued use after the effective date means you accept the updated Terms. If you don't agree, stop using the Service and cancel your subscription.
17. Apple App Store Notice
If you obtained the iOS app through the Apple App Store, you acknowledge that these Terms are between you and MAGE ID — not Apple. Apple has no obligation to provide maintenance or support for the app. To the extent these Terms conflict with Apple's standard EULA for App Store apps, Apple's terms control as to your use of the app from the App Store. Apple is a third-party beneficiary of these Terms and may enforce them against you.
18. Miscellaneous
These Terms are the entire agreement between you and us regarding the Service and supersede prior agreements on the same subject. If a court finds any provision unenforceable, the rest stay in effect. Our failure to enforce a right isn't a waiver. You may not assign these Terms; we may. Notices to us go to help@mageid.app.
